On Thursday, Oneida County District Attorney Scott McNamara decided to drop the charges not only against Bongiovi but also the 21-year-old male student who was with her at the time. According to authorities, the decision was made due to a New York law that prohibits the prosecution of a person who has overdosed or anyone helping them seek medical help for small amounts of drugs or any amount of marijuana. That law went into effect in July 2011 with the intent of allowing people to act when they witness and overdose without fear of legal retribution.
Bongiovi, 19, is a student at Hamilton College in Clinton, NY which is south-west of Utica.
