Steve ‘Pav’ Pavlovic has been cleared of any wrongdoing over unpaid royalties to Tame Impala in a US court and has had his stake in Modular returned via an Australian court.
Pav was accused of pocketing somewhere in the vicinity of $500,000 in payments to the Perth band signed to his Modular Records label.
The case, heard in the Southern District Court of New York, the former Modular boss is not responsible for the missing money.
“I’m pleased that the misunderstanding about the U.S. statutory rate for calculation of mechanical royalties has been resolved in the commercial manner always intended by the parties,” Pav said in a statement. “I’m deeply sorry for any upset caused to Tame Impala given that I’ve always been a staunch supporter and fan of the band; and to BMG given the relationship we’ve always enjoyed with them.”
While the royalty case was being heard in the USA, Pav was also involved in another case with Universal Music in Sydney after losing control of Modular earlier this year. The NSW court has also concluded that an agreement was never reached to sign over Modular to Universal and has ordered that his share of the company be reinstated.
Pav called the case “a waste of time, a waste of energy, a waste of money and a shit ton of stress”. In a Facebook post he wrote, “After 12 months of litigation, a waste of time, a waste of energy, a waste of money and a shit ton of stress the NSW court of Appeal just ruled in my favour and blocked Universal Music from taking my 50% shareholding in Modular Recordings. We’re thrilled with the outcome and look forward to getting back to the business of releasing great records. Stand by for news on forthcoming releases from Movement, Bag Raiders and The Avalanches”.
