Camper Van Beethoven and David Lowery of Cracker have brought a class action lawsuit against Spotify, alleging that they broadcast their music without obtaining mechanical licenses to broadcast the music.
They are seeking $150 million from the company, saying that they knowingly, willingly and unlawfully reproduced and distributed copyrighted compositions. They state that this music was available and streamed to over 75 million users without identifying or attempting to locate the copyright owners.
As a class action, other artists can now join the litigation who feel that they have also been wronged by Spotify.
The lawsuit also states that Spotify publicly acknowledged that they had errored on the mechanical licenses and had created a multi-million dollar fund for royalty payments that are due.
Statutory penalties allow for $750 to $30,000 per infringed work and a maximum of $150,000 in the case of wilful infringement.
