Bands have been throwing picks, drumsticks and other stage paraphernalia into crowds for years but a freak accident has led to a lawsuit against the drummer from Styx.

Todd Sucherman, who has been with the band for 27 years, was playing at a June 28, 2015 show at Aaron’s Amphitheatre in Atlanta, GA when he threw a drumstick into the crowd. The stick hit concertgoer Lori Frederick in the face, according to the lawsuit, cutting her face and “causing serious personal injury”.

Per the suit, “Defendant Sucherman breached the duty of care owed to Plaintiff by willfully and negligently throwing a drumstick into the audience without timely and proper warning to allow Plaintiff to fully protect herself from injury.”

The suit states that Frederick has incurred medical expenses and lost income and will continue to do so in the future. It also says that she lost the “benefit of concert tickets”, supposedly having left the venue to seek medical treatment, “the benefit of registration for the Peachtree Road Race” which she was planning on running at a future date, and loss of clothing from blood damage.

Frederick is seeking reimbursement and damages in an amount that will be “proven at trial”.
